#AskALawyer 011: Investigated for DUI – What’s the Right Thing to Do?

I was at a happy hour yesterday with some buddies and they introduced me to someone new.

“What do you do?” the guy asked.

“I’m a DUI attorney,” I said.

“Really? What the hell should I do if I get pulled over by the cops for DUI?”

That’s the number one question I get from people, so I figured I’d just answer it here and then I could send people here in the future (or maybe get some of you that are just curious about protecting yourself before the fact).

One thing to consider, though, before you run out and drive drunk: this advice will get you arrested.

See, I’m not in the business of teaching you how to snake charm a cop into letting you go. I’m a DUI lawyer. My job is to minimize the damage of your bad decision – to limit the trouble you get into.

So, this advice will get you arrested. But, it will give you the best chance to save your ass when you get to court.

Oh, and one other thing, if you are drunk and you get stopped by the cops or if you simply have a strong odor of alcohol, you are likely getting arrested anyway, so pay attention.

    I get that question too. Everyone thinks there is some magic language to get out of the arrest, like the person that name drops every cop they know. I always say that if you want to get out of a DWI, it will begin with you in handcuffs.
