We’re back with another episode of #askalawyer and this time we’re here to talk about whether or not you can get a DUI if you are asleep in your car.

Unfortunately, I think the answer is that you can.

And, even more unfortunately, I know this because we’ve had several clients who have had to hire us to be their Seattle DUI attorney because this has happened to them.

    I listened to this podcast and would like to add a couple of suggestions: Don’t re-park the car to move it into a better/legal spot after becoming inebriated, park it correctly before drinking begins; don’t sleep in the driver seat, instead get into the passenger seat or backseat; and don’t put the keys into the ignition, place them on the dashboard. Although none of this is a gaurantee to prevent arrest, they might help a case if an arrest occurs. The best alternative is don’t get into the car at all, get a ride – every time.
